Sources in the government said the chargesheet against the 49-year-old Shah was prepared in July after the Election Commission took cognizance of the alleged hate speech.
After examining the evidence, the district police framed charges against Shah. He has been booked for making a hate speech during election rallies at a banquet hall in Naimandi area in Muzaffarnagar. The local police confirmed the video recording of Shah's speech was forwarded to the EC, following which the local administration was asked to probe the case.
"A man can live without food or sleep. He can live when he's thirsty and hungry. But when he's insulted, he can't live. Apmaan ka badla toh lena padega," Shah had reportedly said in his speech, allegedly exhorting the jats to take revenge of west UP riots through votes.
Shah, who was then BJP state-in-charge, has been booked on charges of promoting enmity between groups on religious grounds under IPC section 153(A), and section 125 of the Representation of People's Act. The investigating officer of the case has also booked Shah under IPC Sections 188 (for disobedience to the order of public servant), 295A (for insulting religious feelings) and 505 (for statements leading to mischief).
Inspector general of Meerut zone, Alok Sharma said three cases were lodged against Shah under his zone. "Two cases had been registered at Muzaffarnagar and one at Shamli. Post investigations action had been initiated against him and charges framed accordingly," he said.
