New Delhi: The furore by statements of Nirbhaya rape convict Mukesh reached the Rajya Sabha on Wednesday when Home Minister Rajnath Singh was forced to give a statement over why the permission to shoot a documentary was given.
Replying to the uproar, Rajnath Singh claimed that the filmmaker Leslee Udwin defied the conditions under which the permission was given to her to shoot. Rajnath also added that the "no objection certificate was given by Ministry of Home Affairs in 2013."
The conditions, as stated by the Home Minster are :

1. Prior approval of Tihal jail authorities need to be taken to publish the research papers or for releasing the documentary which is being made solely for social purposes without any commercial interest as conveyed.
2. To interview on only such convicted prisoners who give written consent.
3. The complete unedited footage of the shoot will be given to the jail authorities to ensure that there is no breach of prison security.
The documentary features an interview of one of the accused of the Nirbhaya case. "This came to the notice of the jail authorities that the permission conditions were violated so legal notice was issued to the filmmmaker on
April 7, 2014 to return the unedited footage and not to show the film."
"Subsequently, the film was shown to the authorities and it was noted that it depicts comments that are was highly derogatory. It was also noted that the edited version was shown to the authorities and not unedited one. It was thus asked to further provide unedited version of the shoot," Rajnath said in Rajya Sabha.
He added that after it came to the notice of the government that BBC 4 is scheduled to telecast the documentary on March 8, 2014, the government has taken necessary legal action and obtained a restraining order from the court to not air the film.
He also said that the government condemns the incident of December 16 and assured that it will not allow any attempt of an individual, group or organisation for commercial benefit.
